1. Yt ye Assize of bread and Ale is not observed and kept by ye Bakers and brewers wthin this towne as it ought to bee though corne be at easy rates yet nothing is done for redresse therein according to ye statute in yt case made and pvided wee therefore Desire Mr Maior to take this prsentmt into speciall considracon.

3. Mr Richard Wallcott being lately come into this towne for brewing and uttering of Ale and beare wthout lycence and fyne him in xxs.

4. Thomas Roberts (als Potts) lately marryed or harboured by one Henry Merry he not being a ffree man who dwelleth in ye late house of George Merry decd.

Mrs Langton hath not scowred his ditch and opened her platt at ye head end of her field at Dakergate lane according to ye tenth ordr of ye last Jury of Inquest and find her to have forfeited vjs. viijd. And doe ordr yt ye said Mrs Langton shall scrowre her said ditch and open her said platt before ye first of July next upon paine of vjs. viijd.

That ye occupyers of Thomas Weardens field hath not scowred ye Ditch at ye head end of ye said ffield to Dakergate lane according to ye xith ordr of ye last Jury and find vjs. viijd. to be forfeited. And doe ordr ye ye Occupyers of ye said field shall scowre ye said Ditch before ye first day of July next upon paine of vjs. viijd.

32. Mr Wilm Lemon hath not scowred his ditch downe to ye Ashtree and opened his plat at ye side of Hesketh field according to ye 12th ordr of ye said last Jury and find him to have forfeited vjs. viijd. and doe ordr yt ye said Mr Lemon shall scowre ye said Ditch & open ye said plat before ye first of July next upon paine of vjs. viijd.

Mr Willm Sudell hath not removed his midding lying neare ye Schoolhouse according to he 13th ordr of ye said last Jury and find him to have forfeited vjs. viijd. and doe ordr yt ye said Mr Sudell shall cause ye said midding removed before ye said first day of July next upon paine of vjs. viijd.

Willm Woodward hath not scowred a gutter through Titmouse crofte nor opened a plat nor removed a midding out of ye way leading to Avenam according to ye 14th ordr of ye said last Jury and find him to have forfeited vjs. viijd. And doe ordr yt ye said Willm Woodward shall scowre ye said gutter upon ye said platt and remove ye said Midding before ye first day of July next upon paine of vjs. viijd.

Richard Thorpe hath not scowred his ditch along ye north side of his field by meadowe Leane wch he farmeth from Mr James Hodgkinson according to ye 15th ordr of ye said last Jury & find him to have forfeited vjs. viijd. And doe ordr yt ye said Thorpe shall scowre ye said Ditch before ye first day of July next upon paine of vjs. viijd.

36. Robte Shakeshaft hath not scowred his ditches at both his closes by meadow lane & at ends of his croft according to ye 16th ordr of ye said last Jury & find him to have forfeited vjs. viijd. And doe ordr yt ye said Robte Shakeshafte shall scowre his said Ditches before ye first day of July next upon paine of vjs. viijd.

37. Mr Evan Wall hath not scowred his ditch all alonge his meadowe on ye west side of ye meadowe lane according to ye vjth ordr of ye said last Jury and find him to have forfeited vjs. viijd. And doe ordr yt ye said Mr Wall shall cause ye said Ditch to be scowred before ye first day of July next upon paine of vjs. viijd.

38. Mrs Elizabeth Wearden hath not scowred her ditches alonge both sides [of] her meadow by meadow lane to ye great watercourse wch leadeth downe to Ribble according to ye 18th ordr of ye said last Jury and find her to have frofeited vjjs. viijd. And wee doe ordr yt ye said Mrs Wearden shall cause ye said Ditches to be scowred before ye first day of July next upon paine of vjs. viijd.

39. Richard Thorpe hath not scowred his ditches on both sides of his meadowe by meadowe lane according to ye 19th ordr of ye last Jury and find him to have forfeited vjs. viijd. And wee doe ordr yt ye said Richard Thorpe shall scowre ye said Ditches before ye first day of July next upon paine of vjs. viijd.

40. Thomas Birch hath not scowred his ditch alonge at ye east end of his meadowe by ye north meadowe lane according to ye 20th ordr of ye last Jury And fynd him to have forfeited vjs. viijd. And doe ordr yt ye said Thomas Birch shall scowre ye said Ditch before ye first day of July next upon paine of vjs. viijd.

41. Yt ye now Balives have not caused winding nor stakeing nor laid ye platt stones even, at ye bridge at ye ffurther end of ye broadgate according to ye 21st ordr of ye said last Jury and find them to have forfeited xs. And wee doe ordr yt ye said Balives shall stake winde pyle & Lay ye said stones Even at ye said Bridge before ye first day of July next upon paine of vjs. viijd.

42. Mr John Marsh cause his ditch scowred from ye Ameshouse to ye Lower end thereof before ye first day of July next upon paine of vjs. viijd.

43. John Thorpe shoemaker hath not scowred his ditch nor opened his platt at ye end of widdow Worthingtons field in fishergate lane according to ye 24th ordr of ye said last Jury and find him to have forfeited vjs. viijd. And doe ordr yt ye said John Thorpe shall scowre ye said Ditch and open ye said platt before ye first day of July next upon paine of vjs. viijd.

44. Martin Maberry, Ralph Eaves, Mr Robte Hesketh & mr Edward Robinson yt they have not removed theire middings forth of ye street above ye ffishergate barrs according to ye 26th prsentmt of ye said last Jury & ye last guild ordr. And therefore find them to have forfeited vjs. viijd. apiece And wee doe ordr yt ye afforsaid psons shall remove ye said middings before first day of July next upon paine of vjs. viijd. apiece.

45. John Higham hath not cutt his wood nor pared his coppe at his crofte at ye south end of his Alley according to ye 29th ordr of ye said last Jury and find him to have forfeited vjs. viijd. And wee doe ordr yt ye said John Higham shall paire and cutt his copp as afforsaid before ye first of July next upon paine of vjs. viijd.

46. John Wood hath not scowred his ditch alonge at ye south end of ye Sucking sikes to ye watercourse nor opened awide gripp through ye midest of ye said Sykes According to ye 30th ordr of ye said Last Jury. And wee find him to have forfeited vjs. viijd. And wee doe ordr yt ye said John Wood shall scowre ye said Ditch before ye first day of July next upon paine of vjs. viijd.

47. Yt ye now Balives have not set Stoopes and Rales at Davell bridge according to ye necessity thereof According to ye 31st ordr of ye last Jury. And wee find them to have forfeited10s. And wee doe ordr yt ye said Balives shall pfect ye said worke before ye first day of July next upon paine of xs.

48. Elizabeth Woodhouse widd, Mr Preston, Lawr Tomlinson & Mrs Luke Hodgkinson have not cutt theire undr wood nor lopt nor cropt theire hedges wch hangs over at both sides of ye Moore lane according to ye 32nd ordr of ye last Jury. And find them to have forfeited vjs. viijd. a piece. And now ordr yt ye said sevrall persons cutt and lopp theire said undrwood as afforesaid before ye first day of July next upon paine of vjs. viijd. apiece.

49. James Hodgkinson hath not removed his midding in St Johns weend Leading to ye church according to ye 37th ordr of ye said last Jury. And find him to have forfeited vjs. viijd. And wee ordr yt ye said Mr Hodgkinson remove ye same midding before ye first day of July next upon paine of vjs. viijd.

50. Mary Townend widd hath not scowred her ditch at ye mooreside between George Hodgkinsons & her field adjoyning to ye Leane leading betwixt Mr Luke Hodgkinsons house & George Hodgkinsons house according to ye 39th ordr of ye said last Jury. And find her to have forfeited vjs. viijd. And wee ordr yt ye said Mary Townend shall sufficeintly scowre ye said Ditch before ye first day of July next upon paine of vjs. viijd.

51. John Hodgkinson hath not scowred his ditch at ye westside of the Intakes at ye moore side according to ye 40th ordr of ye said last Jury. And find him to have forfeited vjs. viijd. And ordr yt ye said John Hodgkinson sufficiently scowre ye said Ditch before ye first day of July next upon paine of vjs. viijd.

52. Roger Sudell of Wiggan house hath not scowred his ditch at Lussell field side to ye Lane according to 41st ordr of ye said last Jury and find him to have forfeited vjs. viijd. And ordr yt he shall acowre ye said Ditch before ye first day of July next upon paine of vjs. viijd.

53. Mr Robte Hesketh hath incroached of ye waste at his house at ye mooreside six yeards in length and ffoure yeards in bredth wch is to be rented at ye Discrecon of Mr Maior & ye Councell according to ye 42th prsentmt of ye said last Jury.

54. Yt by ye 48th prsentmt of ye last Jury of Inquest ye sevrall psons hereafter named are prsented for Incroachmt wth theire cellr staires and Railes and are left to ye Discrecon of Mr Maior and his Councell to be rented. vizt.

Mr Willm Shawe for his staires and railes, Mr Ralph Shorrock for his staires and rayles, Mr Richard King for his celler staires and railes, Richard Livesay for staires, Mr Luke Hodgkinson for 3 paire of Railes, Mathew Read for a Bulke at his Smithy, Richard Tysing for a paire of cellr staires ye Relict of Willm Martin for apaire of rayles, John Chorley sen for two pairs of rayles and Nicholas Watson for a paire of Celler staires.

55. Yt by ye ffourty ninth prsentmt of ye said last Jury, Edward Taylor & John Kay have made Incroachmts wch are left to ye Discrecon of Mr Maior & his Councell to be rented.

56. Yt ye Copps in ye minspitt well weend in ye possession of Thomas Burton and Lawr Mitton are parte of them Incroached into ye said weend further from usuall And ordr yt ye same bee by ye said sevrall psons removed and taken away so yt ye weend bee of ye usuall bredth there before ye first day of July next upon paine of vjs. viijd. apiece.

57. John Greenwood hath made a swinefould & set swine throughes and laid middings in ye minspitt well weend to ye newzance of such as passe that way and doe fine and amerce him in vjs. viijd. And wee doe ordr ye same to be removed before ye 1st day of July next upon paine of vjs. viijd.

58. Yt neither ye said John Greenwood nor any other in ye said weend shall hereafter set any swine troughs, lay any middings or sweepe any matter or thinge to any of ye Copps there whereby any newzance or Infringemt of ye Libties of ye said weend shall or may ensue upon paine of every one prsummeing soe to doe to forfeit for every offence 3s. iiijd.

59. Edward Rigby Esqr, Ralph Shorrock, Widdow Worthington, John Cadman, Elizabeth Harrison widd & Luke Greenfield shall cause soe much of theire garden copps removed in ye minnspitt well weend as are slipped downe over ye usuall water cors and channell there the said Mr Rigby first to cause his removed and soe ye rest in ordr before ye first day of July next upon paine of iijs. iiijd. apiece.

60. Henry Blackhurst for suffring steepe water to runn from his Cestrons into ye streete to ye newzance of his Maties subjects. And we ordr yt he stopp or turne ye same from running that way before ye first day of July next upon paine for every offence therafter committed to fforfeit vjs. viijd.

61. Willm Charnock, Thomas Noblett & Thomas Beckensall for suffring theire middings to lyein St Johns weend to ye newsance of such as passe yt way and contrary to a late Guild ordr in such case & find them to have fforfeited iijs. iiijd apiece.

62. James Wearden Cowp for making an Assault, affray and bloodwipe upon James Tomlinson Millr, And do amerce him in vjs. viijd.

63. James Tomlinson hath made an Assault upon James Wearden Cowp & amerce him to pay iijs. iiijd.

64. George Duddale for Laying amidding upon ye Marsh, he being a fforreine Burgesse living in Ashton And amerce him in vjs. viijd.

65. Hugh Copland, Thomas Cunnerowe?, John Cunnerowe, John Copeland, John Radcliffe, Willm Wiggans and John Whalley suffer theire lime pitts on ye Marsh to be uncovred to ye Danger of Cattle coming there. And therefore ordr yt ye said sevrall psons shall not suffer ye same hereafter to be uncovred in theire absence from them upon paine of every one for every offence therein to fforfeit iijs. iijd. a piece.

66. Yt there are sevrall breaches in ye pavemt in sevrall ptes of ye streetes wch are to be repaired at ye genrall charge of ye towne therefore we ordr yt ye now Balives cause all such breaches and decayes sufficiently repaired before ye first day of July next upon paine of xls.

67. George Bennet for suffring his horses to pasture on ye Marsh and Dames(Dams) there adjacent contrary to ye Guild ordrs and doe Amerce him in vjs. viijd.

68. George Bennet shall sufficiently repaire ye ould and decayes of Mill dame soe yt hereafter ye water breake not out to ye hurt of the highway before ye first day of July next upon paine for every offence or neglect hereafter to fforfeit xls.

69. George Bennet turneth or suffereth a watercourse to run out of Ashton into ye townshipp of Preston to ye Marsh Mill to ye newzance of ye highway there adjacent? being noe platt is laide. And amerce him in vjs. viijd. And doe order yt ye said George Bennet shall make a platt there or stopp and dam? ye said watercourse soe yt it run not into ye libties of Preston before ye first day of July next upon paine of xxs.

70. Thomas Shapheard hath had an incroachmt from ye townes waste adioyning to his garden and hath set quicke trees and Laid wood and Rubbidge upon ye waste neere his house. And suffring the same to continue for along space of time now past and doe Amerce him in xxs. And wee doe ordr yt ye said Thomas Shapheard shall lay forth such said Incroachmt to ye comon & remove all ye said Rubbidge & wood before ye first day of July next upon paine of xls.

71. Thomas Shepheard for suffring his geese constantly to pasture upon ye Marsh contrary to a late Guild ordr. And find him to have forfeited by ye said ordr 3s 4d.

72. Henry Graystocke for ye like & amerce him in ye sume of 3s. 4d.

73. Thomas Graystocke and Willm Graystocke suffer theire geese to pasture on ye Spittle mosse contrary to ye said Guild Ordr and amerce the, in iijs. iiijd.

74. Mr Bushell viccarr yt he cause sufficient Steeles sett at ye clarke yard before ye first day of July next upon paine of vjs. viijd.

75. John Smith yt he sufficiently ditch and fence betwixt ye Syles in his occupacon and ye grounds in ye occupacon of Mr Richard ffleetwood, Mr Evan Wall & Mr Willm Wearden before ye first day of July next upon paine of xs.

76. By the ninth prsentmt of ye last Jury of ye Leete yt A pillory & tumbrell should have been Erected & made by ye now Balives before ye 10th March last and find ye said Balives to have forfeited xxs.

77. Yt ye said Balives shall cause a pillory & cuckstoole Erected on such place as ye Maior and Councell shall thinke fitt before ye first day of July next upon paine of xxs.

78. Mr James Hodgkinson shall cause ye great stone removed yt lyeth neere hill wall in ye minspitt well weend soe yt it be noe further out towards ye weend wch any parte thereof then ye outside of his breeke wall there or yt ye same be clearly taken away before ye first day of July next upon paine of vjs. viijd.

79. Yt there is a steepe trough neare Mr James Hodgkinsons Mault houses from where steepe water runneth into ye minspitt well wch is a great newzance there. And ordr yt ye said Mr James Hodgkinson shall remove ye said steepe trough or cause water wch shall ensue from it to be turned out of ye said well before ye last day of July next upon paine of vjs. viijd.

80. Willm Helme, the wife of John Kilshawe and Mr Luke Hodgkinson miller for fouling and putting much dunge and Rubbidge downe ye channel in ye friergate contrary to a guild ordr in such case and find them to have forfeited iijs. iiijd. apiece.

81. Willm Toogood, George Aynsworth, Thomas Tomlinson, Willm Tomlinson & James Mosse for a pound breach in rescueing and taking goods from ye pindr when he was driving them to ye pinfould & doe amerce them in iijs. iiijd. apiece.

82. John Smith joyner yt he hath suffred his swine to goe unringed contrary to aguild ordr and find him to have forfeited iijs. iiijd.

83. Henry Blackhurst for ye like & yt he hath forfeited iijs. iiijd.

84. Mrs Taylor for ye like And ye she hath forfeied iijs. iiijd.

85. Mrs Preston shall lay a Raile at ye ffoote Bridge in ye oxhey before ye first day of July next upon paine of vjs. viijd.

86. Yt ye platt at ye end of ye broadgate is in decay and ye balives cause ye same sufficiently repaired before ye first day of July next upon paine of xs.

87. Yt ye ffryer lane is in decay and yt ye Surveyors cause ye same sufficiently repaired before ye 1st day of July next upon paine of xxs.

88. By ye 34th prsentmt of ye Jury of Inquest taken 2nd day of March, Anno Caroli Secundus Augustus 15th year, Mr Willm Shawe was to remove an house of office wch he hath Erected undr ye easing dropp of Ralph Shorrock before ye 24th day of June then next following upon paine of xxs. wch is not yet removed wch is a great newzance in ye Buttery of ye said Ralph Shorrocke wee therefore ordr yt yr said Mr Willm Shawe shall cause ye said house of office removed before ye 1st day of July next upon paine of xls. and also upon ye ffurther paine of xs. amonth for every menth yt ye said house of office shall not thereafter be removed.

89. Elizabeth Woodhouse widd for yt by ye Laying of Middings & ahouse of office ye breeke Wall of Willm Wearden sen is decayed and burst down and that by ye Watery Excrement Squizeing and breaking through ye said wall a great newzance and bad smell cometh upon ye backside of ye said Willm Weardens house. Wherefore wee ordr yt ye said Elizabeth Woodhouse shall cause ye said watery Excrement and other ye water to be stopped from goeing on up ye said Willm Weardens wall and backside and yt yt same shall be trained and caused to goe downe her owne backside before ye first day of July next upon paine of xls.

90. Henry Graystocke of Ashton (he not Inhiting wthin ye libties of this towne & Burrowe suffereth his cattle to pasture upon ye Marsh and comon wthin the libties of this towne And therefore Amerce him in xxxs.

91. Henry Graystocke hath incroached upon ye townes waste and hath cast a Rampire or Copp, builded a swine coate, laide a midding upon ye said waste and suffreth ye same soe to continue not wthstanding formr prsentmts thereof made And therefore doe fyne and amerce him in xxs.

92. Yt sevrall ptes of ye highway wch in this Burrough are in very great decay And yt Mr Luke Hodgkinson & Willm Wearden ye younger are supvisors thereof who have neglected to cause ye same sufficiently repaired wherefore wee conceive ye penalty of ye statute in such case pvided is to be imposed upon them.

93. Yt ye wall of ye house of James Sharples adjoyning to ye entry of Thurstan Darwen us hanging over ye said Entry & conceived to be a nuzance there. Wee ordr yt yt said James Sharples shall set & make ye same wall straight before ye 15th day of August next upon paine of xxs.

94. Yt there hath not beene any accompt given by ye Maior, Stewards and others concerned in ye last Guild for ye Revenewes then recds? for the genrall good of this Burrowe and ye Inhitants thereof being it is conceived therewas then received above goods?

95. Mary Townend widd remove her Cole nooke? from undr ye Easing dropp and breeke wall of James Cowp before ye first of July next upon paine of vjs. viijd.

96. Henry Ashton remove his midding adioyning to ye wall of Grace Harrison widd before ye first day of July next upon paine of vjs. viijd.

97. John Threlfall for selling and uttering Ale and beare wthout Lycence and amerce him in xxs.

98. Ann Hughson widd yt she scowre her ditch at ye northside of her close in ffryer laine before ye first day of July next upon paine of vjs. viijd.
