April 1661

Great Court Leet, held on the 10th of April, 1661, before James Hodgkinson (Mayor), Richard Hodgkinson and James Abbott (Bailiffs), and Evan Wall (Steward of the Court).

1. Thomas Silcocke is an Eve dropp, commonly called Eseing dropps, and stands under mens windows lisoning and carrieing stories betwixt neighbour and neighbour, to the great disquietnes of neighbours and to the evell example of others, therefore to pay viijs. iiijd.

2. These psons hereafter named doe retail Ale and beare and turne Cattle upon the moores and Comons of this towne some of them being Stalingrs and some not Stalinged contrary to severall good orders of this Towne and prsentments heretofore made especially the fifth prsentmment of the last leet. Therefore wee find and prsent them according to their severall offences as followeth.

Roger Haworth for retailing Ale and beare 3rd offence xs.

Thomas Kay for turning his horse or mare to the moore 2n offence xxs.

William Lorimmor for turning two mares on the moore 2nd offence xxs.

George Hyndle for retailing Ale and beare 3rd offence xs.

Robert Brindle for the like and being a Maulster xs.

Robert Tomlinson for retailing Ale. 2n offence. xs.

Thomas Sillcocke for retalinge Ale 2nd offence xs.

James Sharples for the like 2nd offence xs.

Henry Cross for the like being not a Stallenger and for turninge his Swyns to the moore xs.

John Smith Miller the like offence xs.

John Turner for turninge his Maire and other Cattle to the moore not beinge Stallenged but dwells at Robt Bayleys house xxs.

George Bennett for turninge a heifer to the moore vs.

Robt Simpson for turninge cattle to the moore by Six at once & some tymes less & soe continues trespassing xxs.

Upon the 17th Ordr of Mr Prestons Guild these psons following to bee very unfill psons to Inhabitt wthin this Towne And that they bee removed forth of this Towne before the ffirst of Sepembr next upon payne of vjs viijd apeece And for every month after if not removed the harboures of them to pay vjs. viijd.

4. The women wch are dresers of the Shambles for that they throw gutts and Garbage into the Streetes & sufer Swyne to pull them in peeces and throwes blood into the Streete wch is anoysome Smell in ye Towne and a most unseemly sight in the Streetes, wee leave the same to Mr Maior to punishe the offendr or to Impose such fynes or otherwise as hee thinks most fitt for the future.

5. Ann Ingham for yt shee continues layinge of her midinge att the ffote of the Churchgate barrs contrary to sevrall prsentmts made by the Jury Leete and Inquest of office as apeares by the 9th prsentmt, of the last Leete, Therefore to pay for the tyme past accordinge to the said prsentmt vjs. viijd. And if shee continues soe doeinge to forfeite and pay for evy offence xiijs iiijd

6. Thomas Walmesley of ye hole house for keepinge younge Beafe on the Marshe contrary to the ordr of this Towne therefore to pay for the tyme past iijs. iiijd. And if hee continues for to bee to forfeit iijs. iiijd for evy ofence.

7. Henry Graistocke for takinge his Swyne unlawfully forth of the pinfoulds beinge then imponded therefore to pay iijs. iiijd.

8. Lawr: Tomlinson, Thomas Tomlinson & William Tomlinson for makeing a tusle and drawinge blood upon the body of Richard Blackburne to the breach of his maties peace therefore the said 3 Tomlinsons to pay each of them a peece vjs. viijd.

9. John Anderton for a tusle and blood wipe upon the body of John Taylor therefore to pay vjs. viijd.

10. John Taylor for makeinge a tusle and drawinge blood upon the body of John Andrton therefore to pay vjs. viijd.

11. Geo. Hodkinson, Thomas Dolphin, Roger Charnock, Robt Bayley, Thomas Kay, Lawr Cowper, John Tomlinson and Evan Birley should have repaired the foote Cawsey upon the Peele moore leadinge to Debdale brook, wch is alltogether in decay & made unpassable wch they have neglected to doe, therefore evy one of them to pay for the tyme past vjs. viijd. And to cause the same repared and the platts Laid right, and the bridge at the said brooke Laid upp and made passable before the 15th of August next upon payment of vjs. viijd. a peece.

12. The Bailiffes of this Towne shall cause the Cawles on the Marsh repaired And shall also cause the newe Cawsey behind Churchgate barrs and other broken places in the Streetes to be paved before the 15th of August next upon payne of xxs.

13. These psons followinge for apearinge att the Leete Court now hold therefore each of them to pay ijs apeece. 14. John Taylor for making abuse and Gratinge of Old Raph Woodhouse therefore to pay iijs. iiijd.

15. Thomas Dolphion for yt hee contrary to the 25th ordr of Mr Prestons Guild hath entertained and recd into his house Mary Ingham who is lately delivered of a bastard child wth a fforaigner wch is likely to become burthensome to the Towne, Wee leave the same to Mr Maior and Councell to put the said Ordr in Executon.

16. Henry Graddell the 11th Ordr of Mr Prestons Guild for abusing of office, ffor that hee by railinge speeches utiball? and unseemely words and Curseings uttered and spoken against the Maior of this Towne and Comon Councell of the said Towne to the Evil Example of others to offend in the like if not prsented, Wee therefore amerce him accordinge to the said ordr for the first offence in vjs. viijd.

17. Richard Toogood for rescusinge fower horses from the pinders in conveyinge them towards the fould therefore to pay vjs. viijd.

18. Edward Hindle for that hee hath not removed a midinge Lyinge in the path waies in Water willowes nere Corker hole wch anoyeth the Comon paths there, before the first of May last upon payne of vjs. viijd. And that hee should not lay anie more there to stopp or anoy the said ffote paths upon payne of vjs viijd for every month accordinge to the 20th prsentmt of the mast Inquest, Therefore to pay vjs. viijd for the tyme past And vjs. viijd for the evly month since first of may last And for evy month the same shall ly there to the Annoyance or Stoppage of the said ffoote paths to pay vjs. viijd.

19. Henry Chorley for that hee hath not removed a Staffe hedge wth qint Setts placed and Sett on the Lands of Mr James Hodgkinson now Maior. new unto his kiln?, a yard and a qtr distant and wthin the ancient place where the hedge formly stood tyme out of mind, And wch wee should have removed before the jst of May last upon payne of vhs viijd accordinge to the 25th prsentmt of the last Inquest. therefore to pay the said fyne of vjs. viijd. and for evy month after unremoved vjs. viijd.

20. Mr James Abbott Baliffe of this Towne for takinge the key of the Hall doore, and premprorily refuseinge to delivr the same key to the Sergents being then Comanded to require the same by Mr Seth Blakhurst then deputy Maior and the rest of the Aldermen and Councell they then haveinge speciall occasion to meete in the moote hall upon Extraordinary occasion for the good and welfare of this Incorporacon. Wee leave the same to the ordr and Consideracon of Mr Maior and Councell to doe therein as they shall thinke fitt for such a Contempt.

21. The Baliffes of this Towne shall cause the Syke troughs on the Spittle moss and the Syke troughs upon Avenham to bee put in suficient repaire And alsoe to cause Chaynes and bucketts for the drawe wells in the Markett place and ffryergate to be pvided & made in good repare before the xiij th of September next upon payne of xxs.
